I don't even need to read the whole thing to know that you should be making the claim right now....DON'T PUT IT OFF ANY LONGER!!!

Does the 45 days for a Paypal claim start from when you won the item or from when you paid?

Agreed - Log a DISPUTE ASAP! Then if you get the box you can cancel the dispute easily :)

So have you raised it to a claim ???

In cases like this, and you think the seller is legit.

I always say "I'm gonna claim, but if you sent the item as mentioned. I will Paypal the monies back to you if the item arrives later on".

Have not received a neg ever.

I do this too Mike. And have in fact re-sent money 3 times because the card arrived after 8 weeks cause the stupid postal service put an 'airmail' item into 'shipping/sea freight'.

Sounds like you just got that dispute open in time Leroy! Now you'll have 20 days to escalate it to a claim, but since this seller is clearly a dick, do it now.

Communication solves a lot of problems.

And like I said, if the sellers are legit, they don't have any qualm with it.
 
Yeah man...... I've learned my lesson from things like this - where the seller mucks you around for just enough time for you to not be able to lodge a claim - no matter the situation always make sure you lodge the claim; & if the item comes in then you can then cancel the claim or send them their money back.

I haven't ever tried it, but if you paid via credit card through paypal you sould be able to go through you bank/credit card company to get a refund.

I believe this is against the Paypal TOS & you'd probably get your account suspended if you did so.

I have done this and my account was not suspended, contacted CC company, they sent paperwork to sign, sent back, about 6 weeks later received notice my money had been returned,:D

i made a claim with the topps box which was in the 45 day time period and its on the same status as the Exquisite box, don't wanna ask a stupid question but whats the difference between a dispute and a claim if there is any? i found the transaction in the history part of my paypal account and went on to make the claim in the resolution centre where is says have you got ur item and then you write out a description to the seller...then it says im waiting on a response from the seller and we have 20 days to work something out...
do i do the ebay dispute too?....
just inexperienced with this stuff which is a good thing i reckon;)
i don't wanna be doing this too much in the future coz this sucks....

A claim is when the dispute process doesn't work (no communication, or no agreement reached), which then puts it in the hands of Paypal to sort out. I'm pretty sure the seller needs to prove the item was sent and received to stop you from getting your cash back (or otherwise he must have no funds in his account to pay back with....not 100% sure what happens then, but I would think that credit card insurance should cover that instance).

i just wanted to know if i need to do anything else but sounds like im waiting on him now...
so if he has no funds in his account and doesn't agree to my refund then i don't get anything?...i thought paypal pay me if its found i won the claim and then its up to them to chase up the $$$ from him...is that right?...
there's no way with his story of sending out 2 boxes registered/insured that he's gonna agree to give my money back....
 
mate you should have made the dispute earlier.
They guy is obviously beating around the bush. I'd beat his ass if i were you.

the 08 Topps Box has been fully refunded:)
and he replied to me about the Exquisite saying that the 2nd box should arrive any day now and that he is disappointed that i went as far as opening up the paypal claims...
in the message i sent him yesterday i just said 'u have left me with no choice but to make a paypal claim and actions speak louder than words kinda thing'...and he replied to me saying that when i get my box next week then his words and promises were legit and true....mmmm i guess i'll have to wait and see now what happens, i hope it does turn up coz i'd rather a box than my money back:)

This whole scenario sounds VERY suspicious (to be stating the obvious). As long as it hasn't been signed for in Australia - I can't see that the seller can win the paypal dispute - if they were truly lost in the postal system, he'd have to claim back the money from the insurance. Do others agree?

I'm sure the people that mentioned this are correct, although it depends on the terms and condit. of your credit card - online fraud protection/purchase insurance is a feature on many gold/platinum cards - definitely worth exploring if Paypal does the dirty.

I must admit; I received a card last week postmarked Feb 22nd, 2007 - I never made a claim as it was a <$10 card, but it proves how dodgey the mail system is!

yeah paypal have closed down the claim with the Topps box and i have been refunded my $$$
with the Exquisite box i haven't got a reply from the seller through paypal but he has replied through ebay/e-mail....i guess he's gonna wait a few days into the week to see if the box arrives like he said i will....

i won the box for $20us but with about $25 shipping on top so that might ring some bells if he sent that one....who knows that might still pop up maybe.....

Mate my advice is to not bother waiting - Raise the dispute up to a claim by mid next week......if you get the box you can cancel it!

got a pick up notice from my post office and the box is like the only thing left incoming so im 95% sure that it...
will confirm when i get home from work but if it is looks like a 07 Exquisite box is getting opened tonight on the boards:v:
wish me luck and massive mojo coz after the crap and stressing out i've done the last month over this i think i deserve at least one nice card:lol:;)
