Problem with a big $$$ purchase! What can I do if Paypal cant chargeback?

Its not card related but thought some of you guys might have some idea. Recently bought something off eBay for around $3000, never really thought about the risk as the guy had 98 feedback and it didn't seem to have any problems with anyone. Anyway I paid through Paypal over 2 weeks ago and since then I've had excuse after excuse aboiut it being sent. I'm now starting to get really worried as I still havn't got a tracking number and keep getting fed more bullshit about why it hasn't been sent yet. I filed a claim with Paypal today but what I want to know is if Paypal trys to chargeback but he has cleared out his account what can I do? Is there any other way I can report this? Since its such a large amount of money could it be investigated as fraud by the US police or anything? I just really have no idea what to do!
 
Yes you could try the US police if you have his address, but it'll be difficult.. hopefully paypal will come thru with the goods... what was the item?
 
But if he's withdrawn the money from Paypal to his bank account they can't take money from nothing and return it. Surely there must be a way to do something. I read somewhere about Police now having a link with Paypal to access details of account etc but I wouldnt know where to start or who to contact.

Was a car part.
 
Matt; there is a US Internet Fraud investigation service, i got burned recently with paypal where he had cleared funds and i got $0 back even though i won the claim and a few people suggested i use this service, but since mine was only $60 i didnt bother, but i will try get the addy for ya

Im just really hoping it gets sent in the end, hopefuly the Paypal dispute might scare him a little or something.
 
If it was paid using Credit Card, ring them first thing tomorra, tell them what's happening, they should be able to to reverse the transaction.

Ring PayPal also, instead of communicating via the internet/emails. You might get some foreign dude, but at least you're talking to them, and they understand your side more so.

Hope all works out.

Oh, and email the dude AGAIN, and ask for:
Shipment date
Tracking number

If they don't provide you with anything, they're trying to take you for a run.

Yeah I was thinking it might be best to call them as this is pretty serious, Im still studying and thats alot of money!

I've been really calm and nice to the guy and he keeps saying tomorrow, or its booked to be picked up this day etc. Then I got a little narky and complained and he wrote back quite abusive "You'll get your item mate, Ive been busy!!"

Matty, just ask him straight out when he sent it.

As for Credit Card company, it's fraud, and can be recovered. That's why they provide insurance with over the internet payments. People just don't realise it's there.

yes with that large amount you can call the police and that big of an amount is also a felony charge, but he will probaly send the item once he see's you have a paypal claim going (I see lots of high end deals turn out with someone making a claim then recieveing it a couple days later)

My blood is absolutely boiling right now! This is the response I got:

First of all the buyer did not pay in the specafied time in the auction which was 5 days. If he could not afford it then he should not have bid on it. (HE GAVE ME THE TOTAL WITH A REDICULOUS SHIPPING COST, I THEN ASKED HIM TO GET QUOTES FROM COMPANIES I LISTED WHICH IS WHY IT WAS NOT PAID WITHIN 5 DAYS) The buyer was asked to pay several times would not respond until I told him I was going to relist,he was also told that I would be going on a 2 week vacation starting the night before thanks giving I guess he expected me to reschedule my vacation to wait until the money cleared. (I PAID 4 DAYS BEFORE HIS VACATION!) I set up a quote for shipping gave him the price and he cried about that and asked me to declare the value for $400 (HE ASKED ME WHAT I WOULD LIKE IT DECLARED AT TO TRY AND AVOID CUSTOMS SO I GAVE HIM A PRICE) but I thought that a bad idea and later listed it at its full value of $4700 usd for customs (I PAID $2100 SO HOW CAN HE PUT THE VALUE AT THAT!!) , because if anything happens we will both be covered.I asked a friend of mine to set up the pick up,but where I am i have no phone reception I comi into town every couple of days for supplies and can use a computer (INTERNET BUT NO PHONE CONNECTION?!?!?) .So either he can wait till i get back or untill i get a hold of my buddy like i said I am on vacation 1800 miles from home not my fault he could not live up to his responsibilities I will not cut my vacation short for an idiot.
 
Also I might ass he charged me over $60 US for "Paypal Fees"

I need this part for an upcoming car event here in Adelaide which I have already paid non refundable entry to so Ill be losing another $100 there!

Shit, that was his Paypal response? Well, you can disprove a bit of that (about paying on time, vacation times etc.) with the emails sent between you, and if the part gets held up in customs you can use the ebay invoice to clear up that problem (although it will still have import tax, being over $1000, I think?). Also, if you have evidence of him charging you for Paypal fees, send that in as ebay/paypal will actually act on that as it breaches their rules/policies.

So as long as you can prove you have lived up to your "responsibilities" I don't think he has anything on you. That sort of thing is just the shit though...
 
Well it is because of the fact that even including shipping I got the item about $1000 cheaper than what i could get it anywhere here for.

I havnt rang Paypal yet I'll see what he responds back next.

Its pretty obvious is "friend" hasn't sent it otherwise I would have a tracking number by now. Why do people have to be so arrogant when I'm giving them my business?
