I spoke too soon. I believed this guy had wronged me when I initially posted this and after just speaking with ebay I am now I'm convinced he has. If I lay out the issue hopefully someone can help me. I'm ready to be convinced otherwise but the signs are not good.

I purchased a Jumbo hobby box of Topps Series 1 ( $360) from gameaddictaus on the 13/02/2021. There was no pre-sell or pre-order in the listing. Had there been I would not have purchased it. I assumed he had it in hand or that the item was in transit. He messaged me on the 17/02/ with a long winded story about reduced allocations. It sounded like BS. No mention of would I like a refund or would I wait for him to try and get another box?Just a ramble about the state of the hobby and him seeking alternative stock sourcing without any guarantee of me receiving the item. At that point I thought this guy is not legit. I immediately asked him for a refund and said that I was not happy that he hadn't indicated that it was a pre-sell or pre-order. He said he'd cancel the order and a refund was showing as pending on Paypal. I have yet to receive the refund, however, and when I contacted ebay today they said the seller had not cancelled the transaction. It was cancelled soon after.
I just contacted the seller and he says he did cancel the order on the 17/02 as I "attacked" him for cancelling the order without him asking me. That is a lie. I asked him for a refund when he told me that he did not have the stock. Again, when I contacted ebay today they said that the order had not been cancelled.

I'm not sure what's going to happen but I am sure that this bloke is doing the wrong thing or at the very least he did the wrong thing by accepting money for stock he did not have.

I hate myself for giving this seller my money. I always buy directly from the big three in the US ( Blow Out, Steel City and Dave and Adam). I just hope I get a refund.

Make sure he has the stock on hand. This has been a seriously stressful transaction. The word pre-sell, pre-order would have saved a lot of grief.

If you know it's pre-order and you're happy waiting that's different. I have never done pre-order and I wouldn't have done had I known it was. You shouldn't take people's money if you don't have the stock. That's the last thing I'm going to say about this. I nearly flipped my lid yesterday after speaking to ebay and the seller. I have enough stress in my life without this sort of thing.
